What can I register as a trademark?

You can register both a word mark and a figurative mark. But a colour or colour combination, a shape, a sound, pattern, brand position or hologram can also be registered as a trademark.

What requirements must a trademark meet?

The trademark must be sufficiently distinctive and not too descriptive.

When is a trademark refused?

A trademark is refused if it is too descriptive, lacks distinctive character, is misleading or is contrary to public order and morality.

When do I ™ use and when do I ® use ?

™ stands for "trademark". It means that your trademark name is not (yet) registered in the trademark register but has been registered. After final registration, the ™ can be replaced by ® .

In which countries do I need to register my trademark?

It is wise to register the trademark in the countries where you want to use it. In fact, there are three options: you register your trademark in the Benelux (BOIP), in Europe (EUIPO, 27 EC member states) or per country individually (WIPO). Please note that it may be more advantageous to register EUIPO instead of individual registrations in, for example, Spain, Germany, France and Italy.
